Honra, buen nombre e intimidad

«BOGOTÁ TIEMPO» no gestiona foros propios.

Materiales y colaboraciones no solicitados

Derecho aplicable y autoridades competentes

Purpose and scope

This notice identifies the publisher and sets out general provisions concerning the content and services of “BOGOTÁ TIEMPO”. Colombian law applies where required by the activity, legal relationship or relevant territorial rules. The international location of the participating entities does not exclude mandatory provisions applicable in Colombia or, by itself, establish the exclusive application of foreign law.

Information of interest

58 years ago (as of 1 January 2026), the Colombian daily newspaper “BOGOTÁ TIEMPO” was founded by Cristóbal Ochoa in the Chapinero district of Colombia’s capital, Bogotá, and first appeared on 1 May 1968. In its new edition, “BOGOTÁ TIEMPO” grew from a local voice into a Colombian national institution, revered as a daily newspaper for its unwavering commitment to truth, integrity and social progress. “BOGOTÁ TIEMPO” pays particular attention to coverage of social issues, human rights and the promotion of Colombia’s peace process. At the same time, “BOGOTÁ TIEMPO” distinguishes itself through investigative journalism and in-depth analysis that shape public discourse and drive change, from penetrating analyses to courageous revelations that move the country. “BOGOTÁ TIEMPO” provides news and opinions 24 hours a day, seven days a week, in six languages: Portuguese, Spanish, English, German, Italian and French, with the mission of delivering quality journalism that informs, inspires and connects.

The present digital publication “BOGOTÁ TIEMPO” revives this historic newspaper title. The year in which the historical publication first appeared does not imply uninterrupted publishing activity or legal identity with that publication.

Editorial profile

“BOGOTÁ TIEMPO” is a newspaper with a liberal-conservative orientation whose editorial direction is determined by its editorial management. Independent journalists contribute to its various sections. The publication covers politics, economics, culture, society, human rights, civic participation and international, national and regional affairs, with particular attention to Bogotá and Colombia.

Editorial code and ethical principles

Journalism is guided by independence, professional diligence, truthfulness and respect for fundamental rights. News, opinion, advertising and commercial communications must be recognisably distinct. Signed contributions express their authors’ positions. Ethical commitments supplement legal obligations and do not replace the rights of affected persons or the powers of competent authorities.

Freedom of expression, information and the press

Article 20 of Colombia’s Political Constitution protects the expression of thoughts and opinions, the right to provide and receive truthful and impartial information, and the freedom to establish media organisations. It recognises their social responsibility, guarantees rectification under equitable conditions and prohibits censorship. These guarantees provide the constitutional foundation for the reporting activities of “BOGOTÁ TIEMPO”.

Case law on facts, opinions and reporting responsibilities

Constitutional Court Judgment T-391 of 2007 distinguishes factual reporting from the expression of opinions. Factual information is subject to requirements of truthfulness and impartiality; value judgments are not verified in the same way. Constitutional protection includes critical or uncomfortable expression, but requires consideration of affected rights and does not protect presenting insufficiently supported assertions as established facts.

Honour, reputation and privacy

Articles 15 and 21 of the Constitution protect personal and family privacy, reputation and honour. Public prominence does not extinguish private life. Disclosure should relate to a matter of general interest and avoid unnecessary publication of intimate details. The truth of a private fact does not, by itself, justify every form of public exposure.

Reporting on investigations and judicial proceedings

Judgment T-040 of 2013 emphasises diligence when reporting on judicial investigations and the importance of avoiding misleading headlines. Coverage will distinguish between complaints, investigations, accusations and convictions. Reporting must not anticipate a finding of guilt or maintain a misleading account of a person’s procedural position. Headlines, images and summaries must correspond to the content and known status of the proceedings.

Third-party statements and attribution of allegations

Third-party statements must be clearly attributed and distinguished from assertions adopted by the publication. Article 222 of Law 599 of 2000, the Criminal Code, addresses indirect injuria and calumnia. Referring to another source or using impersonal wording does not automatically exclude liability. Publication must respect constitutional safeguards for journalism and the requirements of applicable law.

Limits of criticism and constitutional case law

Judgment C-442 of 2011 examined the criminal regulation of injuria and calumnia and its relationship with freedom of expression. Applying these offences requires consideration of their elements and constitutional interpretation; a severe or unpleasant opinion is not automatically criminal. Criticism concerning matters of public interest must be assessed in context and with respect for the enhanced protection of democratic debate.

Personal image and social media publications

Judgment T-634 of 2013, dated 13 September, recognises that authorising use of one’s image does not permanently waive that right and requires attention to the authorised purpose. A photograph’s availability online will not, by itself, be treated as permission for unrestricted reuse. Editorial and advertising uses require sufficient grounds and must respect image rights, privacy and other applicable rights.

Right to rectification under equitable conditions

Persons affected by inaccurate or erroneous information may request rectification at [email protected], identifying the publication, disputed facts and reasons. Judgment T-219 of 2009 requires public rectification by the party that disseminated the information, with equivalent prominence and effective acknowledgment of the error. A private response or publication that preserves the distortion does not, by itself, satisfy these conditions.

Prior request and constitutional protection proceedings

Article 42(7) of Decree 2591 of 1991 governs acción de tutela proceedings against private parties where rectification of inaccurate or erroneous information is sought. Under that provision and applicable case law, evidence must be provided of the publication and the rectification request that did not receive an effective response. This specific prerequisite does not generally prohibit obtaining legal representation or waive other available remedies.

Updating reports and news archives

Preserving a report must allow its historical context to be understood. Where subsequent events materially change the situation described, updating may be necessary to avoid a misleading account. Decisions ending proceedings must be identified accurately, distinguishing, for example, acquittal, closure and expiry of the limitation period, without treating their legal effects as identical.

Case law on digital archives and search engines

In Judgment T-277 of 2015, dated 12 May, the Constitutional Court addressed an outdated report on criminal proceedings available online. It ordered measures directed at the publisher to update the information and restrict its discoverability through search engines while preserving the publication. The decision does not require automatic deletion of every old archive or removal of all unfavourable information; the circumstances and rights in each case must be considered.

Freedom of expression on social networks

Judgment SU-420 of 2019, dated 12 September, established criteria for resolving conflicts between freedom of expression, honour and reputation on social networks. Judicial intervention depends on procedural requirements and the context of the communication. Disagreement or discomfort caused by a publication does not, by itself, establish unlawfulness or automatically justify removal.

Journalistic independence and source protection

Articles 73 and 74 of the Constitution protect journalism’s freedom and professional independence and the inviolability of professional secrecy. Article 385 of Law 906 of 2004, the Code of Criminal Procedure, includes the journalist–source relationship among exceptions to the duty to testify. “BOGOTÁ TIEMPO” will preserve protected sources and communications in accordance with these safeguards.

Responsibility for content

Responsibility for content is determined under applicable Colombian law and the circumstances of each act. Article 2341 of the Civil Code establishes an obligation to compensate harm caused by an offence or fault. Receiving material from agencies or contributors does not create general immunity. This notice does not exclude liability that cannot lawfully be limited.

Reporting possible infringements

Communications concerning possible infringements may be sent to [email protected], identifying the content, its location, the right affected and the information needed to identify the issue. This channel does not require anyone to waive legal representation or replace the requirements for rectification, an administrative complaint or court proceedings.

External links

Links provide access to third-party documents, sources and services. Their inclusion does not necessarily endorse every statement on the linked pages. Responsibility for including or maintaining a link depends on the context, content, knowledge of the circumstances and applicable rules. Classification as an external link does not create an absolute exemption from liability.

Forums and user participation

“BOGOTÁ TIEMPO” does not operate its own forums. Any future introduction of comments or participation features will require terms appropriate to their nature and applicable Colombian law. Third-party contributions must respect the rights of affected persons. Publishing the medium’s own content and hosting contributions from others will be assessed according to the functions actually performed.

Advertising and commercial communications

Advertising and sponsored content must be distinguishable from editorial material. Law 1480 of 2011, the Consumer Statute, prohibits misleading advertising. Article 30 establishes advertiser liability and provides for the medium’s joint and several liability where intentional misconduct or gross negligence is established. Identifying the sponsor does not authorise misleading claims or replace applicable sector-specific restrictions.

Contracted services and consumer protection

Where Law 1480 of 2011 applies, contracted services must respect information, quality, fitness and contractual protection requirements. Before contracting, customers will receive information about the provider, service characteristics, total price, duration and relevant terms. E-commerce must comply with Article 50, including the amendments introduced by Law 2439 of 2024.

Right of withdrawal

Article 47 of Law 1480 of 2011 provides, in the circumstances it regulates, five business days to exercise withdrawal, starting from delivery of goods or conclusion of a service contract. Statutory exceptions apply, including services begun with the consumer’s agreement. For e-commerce, Law 2439 of 2024 sets a maximum refund period of fifteen calendar days, once withdrawal is exercised and statutory information and return obligations have been fulfilled.

Payment reversal

Article 51 of Law 1480 of 2011 regulates reversal of certain electronic payments involving fraud, unsolicited transactions, non-receipt, incorrect products or defects. Where applicable, the consumer must complain to the supplier and notify the payment-instrument issuer within the statutory five-business-day period, complying with the other legal requirements.

Consumer complaints and competent authority

Complaints may be sent to [email protected]. Article 58(5) of Law 1480 of 2011 provides for direct complaints and a fifteen-business-day response period. Available legal actions and remedies remain unaffected. The Superintendence of Industry and Commerce — SIC exercises its statutory consumer protection powers. Institutional information: www.sic.gov.co.

Data messages and electronic contracting

Law 527 of 1999 recognises the legal effects and evidential value of data messages subject to its requirements. Electronic contracting must allow acceptance to be established and relevant information preserved. A communication is not denied validity because it is electronic, but applicable identification, integrity and evidential requirements remain relevant. Visiting the website alone does not constitute acceptance of unrestricted payment obligations.

These technologies do not guarantee absolute invulnerability or uninterrupted availability.

Personal data protection

Processing subject to Colombia’s general regime is governed by Statutory Law 1581 of 2012 and its regulations, consolidated in Decree 1074 of 2015. Its scope includes processing performed in Colombia and circumstances in which Colombian law applies to controllers or processors outside the country under the relevant rules and treaties.

Journalistic information and editorial content

Article 2(d) of Law 1581 of 2012 exempts databases and archives of journalistic information and other editorial content from the general regime. Judgment C-748 of 2011 examined this exception as a safeguard for press freedom. Data protection principles and constitutional rights remain relevant; the exception does not automatically cover customer, advertising, subscription or administrative databases.

Controller and contact

SCANDIC TRUST GROUP LLC acts as controller for processing whose purposes and conditions it determines. Enquiries and complaints may be sent to [email protected]. Information given when collecting data must identify the controller, explain purposes and rights, and indicate the optional nature of responses concerning sensitive data or children’s data where applicable.

Authorisation, purpose and data quality

Where required, processing needs prior, express and informed authorisation recorded in a form that can subsequently be consulted. Data will be used for legitimate, disclosed purposes and must meet statutory quality requirements. Exceptions to authorisation do not remove other applicable obligations concerning security, confidentiality and respect for individuals’ rights.

Data subjects’ rights

For processing governed by Law 1581 of 2012, individuals may obtain information about, update and rectify their data, request evidence of authorisation where required, receive information about use and access their data under statutory conditions. They may also request withdrawal of authorisation or deletion where applicable. Deletion is not required where an ongoing legal or contractual obligation justifies retention.

Deadlines for personal data enquiries and complaints

Enquiries must be answered within ten business days of receipt, with a maximum statutory extension of five business days where necessary. Complaints must be resolved within fifteen business days, starting the day after receipt, extendable by up to eight further business days under the statutory conditions. Any delay must be notified with reasons and the response date. Rules on completing deficient requests apply where relevant.

Data protection authority and remedies

The Superintendence of Industry and Commerce — SIC, through its competent data protection authority, exercises the functions established by Law 1581 of 2012. Article 16 requires prior completion of the enquiry or complaint procedure before the controller or processor before bringing the corresponding complaint to the SIC. Constitutional remedies remain available where their requirements are met. Institutional information: www.sic.gov.co.

Cookies and similar technologies

Where cookies or other technologies collect or process personal data, applicable Colombian information and authorisation requirements must be respected. The SIC has expressly recognised that collecting data through cookies can constitute processing performed in Colombia. Measurement, personalisation and advertising purposes must be explained understandably; continued browsing alone will not be treated as unlimited authorisation.

Providers and data transmission agreements

Where a processor handles data on a controller’s behalf, the transmission agreement must define the processing scope, assigned activities and corresponding obligations. Article 2.2.2.25.5.2 of Decree 1074 of 2015 requires attention to authorised purposes, data protection principles, security and confidentiality. Purchasing infrastructure services does not grant the provider unlimited powers over the data.

International transfers and transmissions

Transfers to another controller and transmissions to a processor are governed by different rules. International transfers must comply with Article 26 of Law 1581 of 2012, including applicable requirements concerning adequate protection, exceptions or a declaration of conformity. Transmissions are governed by the specific provisions of Decree 1074 of 2015 and applicable SIC instructions. A server’s foreign location does not, by itself, establish compliance.

Copyright protection

Protected content is governed by Law 23 of 1982, its amendments and Andean Decision 351 of 1993. Reproduction, distribution, adaptation or communication to the public requires permission unless an exception applies. Online availability does not constitute a general licence. Both economic and moral rights, and the terms applicable to third-party material, must be respected.

Quotations and reuse of content

Article 31 of Law 23 of 1982 and Article 22(a) of Andean Decision 351 permit quotations subject to their statutory requirements. Identification of the author and source or work, fair practice and an extent justified by the purpose must be respected. Disguised substantial reproduction does not become a lawful quotation merely because a link or attribution is added.

Automated extraction and use of archives

Automated collection, extraction or reuse of texts, photographs, databases and other content must respect the rights actually protecting them and applicable exceptions. Using automated tools does not, by itself, expand permission to reuse content. This provision does not claim exclusive rights over facts, ideas or material that are legally unprotected.

Unsolicited materials and contributions

Submitting text, photographs, documents or other material does not guarantee publication or automatically create an entitlement to payment. Contributors must hold the necessary rights and identify restrictions on use or confidentiality requirements. Receipt does not constitute an unlimited assignment of rights. Professional contributions will be governed by the relevant agreement.

Protection of children and adolescents

Law 1098 of 2006, the Childhood and Adolescence Code, establishes special media responsibilities in Article 47. The priority of children’s rights and restrictions on interviewing or identifying child victims, perpetrators or witnesses of criminal acts must be respected. Exceptions and authorisations remain subject to the law and the child’s best interests; they do not justify harmful or discriminatory exposure.

Availability and nature of information

Content reflects the information available in its publication context. Services may be interrupted by maintenance, technical incidents or other circumstances. General information does not constitute individual legal, medical, financial or other professional advice. These qualifications do not exclude duties of care or the rights of customers purchasing services.

Applicable law and competent authorities

Applicable law and jurisdiction will be determined under the relevant Colombian and international rules and the nature of each relationship. This notice does not impose general exclusive jurisdiction on foreign courts or restrict access to Colombian authorities where they are competent. Specific service terms must respect applicable mandatory rules and consumer rights.

Legal validity and language versions

This notice is provided in Spanish and English. Both versions should be interpreted consistently, respecting the official texts and scope of the legislation cited. Invalidity of a provision does not permit its replacement with a restriction contrary to mandatory rights. Subsequent amendments will be identified by the update date and will not retrospectively alter acquired rights.
